IT IS TIME FOR INHERITANCE PLANNING

From August 17, 2015, the date on which the statutory vacatio legis period expired, all community or non-community foreigners residing in Spain, and who want their inheritance to be regulated by their own national law, must expressly state so ( “professio iuris”) in the manner provided by the new regulations.

Otherwise, the law applicable to the succession will be that of the State in which the habitual residence is held at the time of death, regardless of the nationality of the deceased.
