what is the Nationality Oath?


After receiving the grant of nationality in a favorable manner, the next step is to be sworn in or promise to respect the Spanish Constitution and its laws. It's about avery simple process and that will not generate any type of problem, but that requires formally following the steps that we will see in this article.


There are two ways:

  • Swear
  • Pledge (in the latter case there would be no associated religious connotation).


But both options are legally equivalent.


Through this procedure you will be registered for the first time in Spain as nationals through the birth certificate; and, according to your country of origin, it will be the moment in whichyou must renounce your nationality of origin to be able to acquire the Spanish one(if you can notmaintain dual citizenship).


Once you receive the resolutionhave been granted Spanish nationality, you have 180 days to take the oath, which can be processed in two different ways. For them, you must request an appointment for this last phase of the process.

Where is the oath performed?


The oath is made in the Civil registration located in the town where you are registered at that very moment.


To go to the registry to formalize the oathyou will have to make an appointment. How to do it depends on the place in question, since in many cases they have an online platform enabled so that you can request the appointment online, and in other cases you will have to go in person to request the date and time.


Since September 2021,now it is also possible to swear before a notary. This procedure, although a little more expensive, is faster and more agile.

Documents that you must provide on the day of the appointment



On the day of the oath, you must bring the following documents with you:


  • favorable resolutionof Spanish nationality and its acknowledgment of receipt
  • Passport, which must be the original and must be in force
  • Residence card, must be in force (you cannot be in an irregular situation) or receipt if you are in the middle of a renewal
  • Certificate of registration
  • Birth certificate(the same one you used in the nationality application)
  • Your mother's birth certificate (in the case of having only one last name)
  • Criminal record(the same one you used in the nationality application)
  • Data declaration sheet, a document that contains basic information such as name, surname or place of birth.



It is important to mention that criminal record certificate and birth certificate are two documents that you should not provide if you submitted your nationality file through the Civil Registry. Only if you did it electronically you will have to provide them again in the oath.
